RESUMO: Neste artigo nosso objetivo é analisar as fontes
formais de Direito Internacional que obrigam os Estados a adotarem o regime
democrático e a respeitarem os direitos humanos. Nós focamos o princípio da
autodeterminação dos povos previsto na Carta das Nações Unidas (1945); e
também as cláusulas democráticas adotadas pelos ordenamentos jurídicos
da União Européia e do Mercosul. Finalmente, nós consideramos, em nossa análise,
a contribuição do Sistema Interamericano de Direitos Humanos.

ABSTRACT: Our aim in this article is to study the formal sources of International Law that oblige sovereign States to adopt a democratic regime and to respect human rights. We focus on the principle of self – determination of people set out in the Charter of Nations (1945). We also analyse the democratic clauses adopted by the legal systems of the European Union and Mercosul. Finally, we consider the contribution of the Interamerican System of Human Rights.
