THE EFFECTIVENESS OF HUMAN RIGHTS: THE CONTEMPORARY

Resumo: A problemática dos direitos humanos vai atrelada à
idéia de permanecer em abstração ou procurar sua realização em dependência do
fator jurídico. Nesse sentido, o direito positivo é uma condição de eficácia e
efetividade dos direitos humanos e o Estado democrático de direito deve ser uma
situação cotidiana de estado social permanente, onde a distribuição racional do
poder e o império da legalidade apresentam caráter instrumental. Neste começo de
século, o desafio da contemporaneidade consiste, precisamente, em efetivar os
direitos humanos, ratificando-se seu caráter universal junto a um perene sentido
de humanidade.

Abstract: The problem of human rights has to do with the Idea of remaining abstract or with implementation through a juridical factor. Therefore, positive right is a requirement for efficacy and effectiveness of human rights and the democratic rights state shall be continuous permanent situation of the social state, where the rational distribution of power and the empire of legality present an instrumental feature. In the beginning of this century, the contemporary challenge consists, precisely, in implementing human rights, ratifying its universality with a perennial sense of humanity.
