Resumo: A Constituição do Brasil, promulgada em 1988, mais
do que estabelecer as bases para a construção de um Estado Democrático de
Direito, deixou explicitado no art. 3º as condições necessárias para o resgate
das promessas da modernidade, apontando para a efetiva implantação de um Estado
Social. O novo Texto Constitucional representa, assim, uma ruptura paradigmática
no Direito brasileiro, inserindo-se naquilo que o constitucionalista português
Jorge Miranda tão bem denominou de “revolução copernicana” do
constitucionalismo. A partir dessa ruptura de modelo, é necessário investigar a
realização/efetivação da materialidade da Constituição, pela exata razão de que
o Estado Democrático de Direito é um plus normativo em relação aos modelos
anteriores (Estado Liberal de Direito e Estado Social de Direito). É nesse
sentido que, em face da flagrante inefetividade da Constituição brasileira,
originalmente dirigente e compromissária, torna-se necessária a construção de
uma resistência teórica que aponte para as possibilidades de efetivação dos
direitos fundamentais-sociais.

Abstract: The Constitution of Brazil, promulgated in 1988, more than establish the grounds for the building of the Democratic State of Right, let explicited in the article 3rd the necessary conditions to the ransom of the promises of modernity, pointing to the actual implantation of a Social State. The new Constititutional Text represents, thus , a paradigmatic severance in the Brazilian Law, one inserting in what the Portuguese constitutionalist Jorge Miranda so well denominated as “copernicana revolution” of the constitutionalism. From this severance model, it is necessary to investigate the realization / achievement of the Constitution materiality, by the very reason of that the Democratic State of Right is a normative plus in connection with the previous models (Liberal State of Right and Social State of Right). It is in this sense that, due to the blatant uneffectivity of the Brazilian Constitution, originally directive and commital, one became necessary the building of a theoric endurance that point the possibilities of effectiveness of the fundamental-social rights.
